1. Designated agent
Copyright Agent, Space Made Code LLC Email: legal@spacemadecode.com (subject: "Copyright notice") Postal address: [ADDRESS REGISTERED WITH THE US COPYRIGHT OFFICE] US Copyright Office designated agent registration: [DMCA-XXXXXXX] [to be filed — required for the §512 safe harbour]
2. Sending a copyright notice (DMCA)
Your notice must include:
- your physical or electronic signature;
- identification of the copyrighted work you claim is infringed;
- identification of the material you claim is infringing and information reasonably sufficient for us to locate it (for example the URL, account email or screenshot);
- your name, address, telephone number and email;
- a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law;
- a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf.
Knowingly false notices can create liability for damages (17 U.S.C. §512(f)).
3. What we do
- We review complete notices within 5 business days, remove or disable access to the material if appropriate, and notify the user with a copy or summary of the notice (personal contact details may be redacted where lawful).
- Incomplete notices: we ask for the missing information.
4. Counter-notice
If your content was removed and you believe this was a mistake or misidentification, send a counter-notice to the designated agent with:
- your physical or electronic signature;
- identification of the material removed and where it appeared;
- a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification;
- your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the US, any judicial district in which SMC may be found) and will accept service from the person who sent the original notice.
We forward the counter-notice to the complainant and restore the material in 10–14 business days unless they tell us they have filed a court action.
5. Repeat infringers
We terminate, in appropriate circumstances, the accounts of users who are repeat infringers. As a rule, an account that receives three valid notices within 12 months is terminated.
6. Notices of illegal content from the EU (Digital Services Act)
Anyone can report content they consider illegal under EU or Member State law by email to legal@spacemadecode.com or [REPORTING FORM URL], stating:
- why the content is illegal;
- where it is (URL or other precise location);
- your name and email (not required for reports of child sexual abuse material);
- a statement that the report is accurate and complete to the best of your knowledge.
We confirm receipt, decide in a timely, diligent and objective manner, tell you the outcome and how to seek redress, and give the affected user a statement of reasons. Automated tools used in the decision are disclosed in the statement. Single point of contact for authorities and users (DSA Art. 11–12): legal@spacemadecode.com, in English or Turkish.
